1. Acceptance of these Terms

These Terms of Use (“Terms”) are an agreement between you and Sebastian Kalita (“FourFit,” “we,” “us,” or “our”) governing your use of the FourFit iOS app and related website. By downloading, accessing, or using FourFit, you agree to these Terms and our Privacy Policy. If you do not agree, do not use FourFit.

You must be legally able to enter this agreement. If you use FourFit on behalf of another person or organization, you confirm that you have authority to bind them.

2. What FourFit provides

FourFit provides bodyweight workout plans, timers, progress tracking, reminders, optional prerecorded audio coaching, and optional milestone programs. Audio coaching can announce exercise targets, rest timing, countdowns, and timed-exercise updates, and can be turned off in workout settings. FourFit does not display third-party advertising. Features may change, improve, or be discontinued over time. Some features require a compatible Apple device, a supported version of iOS, iCloud, internet access, or an active Premium subscription.

Some prerecorded voice cues were created using ElevenLabs technology. ElevenLabs does not provide the in-app audio feature to you, and is not affiliated with, sponsoring, or responsible for FourFit.

FourFit does not guarantee that any particular exercise level, result, streak, or fitness outcome will be achieved.

3. Health and safety

Exercise involves inherent risks, including strain, falls, injury, and in rare cases serious medical events. Before starting or changing an exercise program, consult a qualified healthcare professional if you have a medical condition, injury, are pregnant, have been inactive, or have any concern about whether exercise is appropriate for you.

Use good judgment, train in a safe space, follow proper form, and stop immediately if you feel pain, dizziness, faintness, shortness of breath beyond normal exertion, or other concerning symptoms. Seek urgent medical help when appropriate. Never rely on FourFit for an emergency.

Voice cues are provided for convenience and may be unavailable, delayed, interrupted, or inaudible because of device settings, other audio, or technical conditions. Follow the on-screen workout information, verify timers and targets yourself, and never rely on an audio cue as your only safety instruction.

You are responsible for choosing whether to perform an exercise and for adapting or skipping activities that are not safe or suitable for you.

4. FourFit Premium and subscriptions

FourFit may offer automatically renewing monthly and yearly Premium subscriptions. The price and billing period shown in the App Store purchase screen at the time of purchase apply.

• Payment is charged to your Apple ID account when you confirm the purchase.
• Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current billing period.
• Apple may charge your account for renewal within 24 hours before the period ends.
• You can manage or cancel subscriptions in your Apple ID account settings.
• Any refund is handled by Apple under App Store policies and applicable law.

Premium access may include expanded workout levels, complete milestone programs, full program maps, and additional progress features. FourFit remains free of third-party advertising for both free and Premium users. If Premium ends, progress already saved is preserved, but access to paid levels and features may be limited until you subscribe again.

Apple’s standard Licensed Application End User License Agreement also applies where required. If these Terms conflict with mandatory App Store terms, the applicable App Store terms control.

5. Limited license and ownership

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use FourFit on Apple devices you own or control, as permitted by the App Store Usage Rules.

FourFit, including its software, visual design, illustrations, text, branding, workout structures, and other content, is owned by us or our licensors and protected by intellectual property laws. No ownership rights are transferred to you.

6. Acceptable use

You may not:

• copy, modify, distribute, sell, lease, or sublicense FourFit except as permitted by law;
• reverse engineer or attempt to extract source code except where restrictions are prohibited by law;
• bypass subscription controls, security features, or usage limits;
• use FourFit to violate law or the rights of others;
• interfere with the app, related services, or other users; or
• misrepresent your relationship with FourFit.

7. Disclaimers

To the fullest extent permitted by law, FourFit is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that FourFit will be uninterrupted, error-free, secure, compatible with every device, that audio cues will always play at the expected time, or that workout content will meet your needs or produce a particular result.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

8. Limitation of liability

To the fullest extent permitted by law, FourFit and its developer will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or opportunity arising from your use of or inability to use FourFit.

Where liability cannot be excluded, our total liability for claims relating to FourFit will not exceed the amount you paid for FourFit during the 12 months before the event giving rise to the claim. These limitations do not apply where prohibited by applicable law, including liability that cannot be limited for personal injury caused by negligence or intentional misconduct.

9. Suspension and termination

You may stop using FourFit at any time. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, or misuse the service. Provisions that by their nature should survive termination — including ownership, disclaimers, liability limits, and general terms — will remain in effect.

10. Changes and general terms

We may update these Terms to reflect changes to FourFit, law, or business practices. The latest version will appear on this page with a revised effective date. Continued use after an update means you accept the revised Terms where permitted by law.

If any provision is found unenforceable, the remaining provisions stay in effect. A failure to enforce a provision is not a waiver. These Terms, our Privacy Policy, and applicable App Store terms form the entire agreement concerning FourFit.

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules, while preserving any mandatory rights and protections you have under the law of your country of residence.
